General Terms and Conditions (GTC)
of Davy Art Space GmbH

1. Scope of Application
These General Terms and Conditions apply exclusively to the business relationship between Davy Art Space GmbH, Lindengasse 51, 1070 Vienna, Austria (hereinafter “Davy Art Space”), and the purchaser, in the version valid at the time of the order. Deviating terms and conditions of the purchaser shall not be recognized unless Davy Art Space has expressly agreed to their validity in writing.
2. Conclusion of Contract
By placing an order, the purchaser submits a binding offer to conclude a purchase contract. Upon receipt of the order, the purchaser will receive an automated email confirming receipt of the order (order confirmation). This confirmation does not constitute acceptance of the offer. A purchase contract is only concluded once the goods have been dispatched, made available for collection, or expressly confirmed.
3. Right of Withdrawal, Returns
Consumers have a statutory right of withdrawal for distance selling contracts in accordance with the separate withdrawal policy. The right of withdrawal does not apply to goods that are manufactured according to customer specifications or clearly tailored to the personal needs of the customer. The purchaser shall bear the return costs unless otherwise stated in the withdrawal policy.
4. Delivery
Delivery shall take place within a maximum of ten (10) working days after receipt of payment, unless otherwise agreed. Obvious transport damage must be reported immediately to the carrier; this does not affect the purchaser’s statutory warranty rights.
5. Payment
The available payment methods are Shop Pay, Apple Pay, Google Pay, advance payment, credit card, and Klarna. In the event of default in payment, Davy Art Space is entitled to withdraw from the contract.
6. Shipping Costs
Shipping costs are displayed during the ordering process. Any customs duties, taxes, or import charges shall be borne by the purchaser.
7. Retention of Title
The goods remain the property of Davy Art Space GmbH until full payment has been received.
8. Liability
Davy Art Space shall be liable without limitation in cases of intent and gross negligence. In cases of slight negligence, Davy Art Space shall only be liable for breaches of essential contractual obligations and only up to the amount of the foreseeable, contract-typical damage. Liability for personal injury remains unaffected.
9. Warranty
The statutory warranty provisions shall apply. For consumers, the warranty period is two (2) years from the date of delivery of the goods. For entrepreneurs within the meaning of the Austrian Commercial Code (UGB), the warranty period shall be one (1) year from delivery, unless mandatory statutory provisions provide otherwise.
10. Usage Rights
The purchase of a work does not transfer any copyright or intellectual property rights.
11. Data Protection
The privacy policy published on the website shall apply.
12. Applicable Law and Jurisdiction
Austrian law shall apply. For consumers, the statutory place of jurisdiction shall apply. For transactions with entrepreneurs, the place of jurisdiction shall be the Commercial Court of Vienna.
